General Terms and Conditions (Allgemeine Geschäftsbedingungen – AGB)
Here you will find the terms on which you order from us. We have written them so that you can read them without any legal background – what is set out here is nonetheless legally binding, exactly as written. Your contracting party is Michael Jöbstl, an Einzelunternehmen (sole proprietorship under Austrian law) based in Graz, Austria. We design and produce personalised wedding stationery and wedding decor. These terms apply to orders placed by consumers via our website; for orders placed in the course of a business, § 17 applies in addition. Important up front: we currently deliver only to delivery addresses in Austria and Germany. Further details can be found in §§ 4 and 8. You can call up, save and print this page at any time. Version of 17 September 2026. Note on citations: Austrian statutes are cited in their original abbreviated form. In these citations, "Abs" means subsection and "Z" means subparagraph (number).
§ 1 Scope and your contracting party
(1) These General Terms and Conditions apply to all contracts you conclude with us via our website. The version that applies is always the version that was available on the website at the time you placed your order.
(2) Your contracting party is: Michael Jöbstl Einzelunternehmen (sole proprietorship under Austrian law) Puchstrasse 145, 8054 Graz, Austria E-mail: michaeljoebst87@gmail.com Telephone: 06604736784 UID-Nummer (Umsatzsteuer-Identifikationsnummer, Austrian VAT ID): ATU79764514 Website: www.hochzeitsdruckwerk.com (German-language site: www.hochzeitsdruckwerk.at) Further mandatory disclosures under § 5 E-Commerce-Gesetz (ECG, the Austrian E-Commerce Act) can be found in our Impressum (the legal notice required under Austrian law).
(3) These terms are addressed to consumers within the meaning of § 1 Abs 1 Z 2 Konsumentenschutzgesetz (KSchG, the Austrian Consumer Protection Act). If you order in the course of a business – that is, as an Unternehmer (trader/entrepreneur under Austrian law, including sole traders and freelancers) – § 17 of these terms applies in addition.
(4) Your own or differing terms and conditions do not become part of the contract unless we expressly agree to them in text form (e.g. by e-mail).
(5) You can read these terms in full on this page at any time, save them to your device and print them out.
§ 2 What we offer
(1) We design and produce personalised wedding stationery and wedding decor. Our range includes: acrylic welcome signs, table stationery sets, personalised ring boxes, vow books, guest books with a keepsake box, name cards as guest favours, QR code stands and save-the-date magnets.
(2) We produce exclusively using the following processes: high-quality paper printing, direct UV printing on blanks sourced from suppliers, and 3D printing.
(3) At present, the only item that can actually be ordered is the acrylic welcome sign, via the configurator in the wedding section. All other product pages are purely informational: they contain no prices, no delivery or availability information, no reviews and no ordering facility. A product page on its own therefore does not give you any claim to delivery.
(4) The images on our product pages are AI-generated mood images and are marked as such on the website. They show the design style, not the individual piece we will make for you. What is decisive for the agreed characteristics and quality of the goods (Beschaffenheit) is the product description together with the details you select and enter in the configurator.
(5) With printed and material-based products, minor technically unavoidable deviations in colour, surface and texture compared with the display on your screen are possible – screens reproduce colours differently. Your statutory warranty rights under § 11 of these terms remain unaffected by this.
§ 3 Contract language, contract text and correction of input errors
(1) The language of the contract is English for orders placed via this website (§ 9 Abs 1 Z 4 ECG, applied here to the English-language version of our shop).
(2) The individual technical steps leading to conclusion of the contract (§ 9 Abs 1 Z 1 ECG) are: you select the specification in the configurator and enter your personalisation details. You are then forwarded to the checkout page operated by our payment service provider Stripe at checkout.stripe.com. There you enter your billing address and your payment details and see the total amount. It is only when you submit the order with an obligation to pay on that checkout page that you make your binding contractual declaration.
(3) Up until you submit the order, you can identify and correct input errors yourself at any time (§ 9 Abs 1 Z 2 ECG): you can change your entries in the configurator and on the checkout page, go back to a previous step, or abandon the process by closing the browser window. Please check in particular the spelling of names, the date and all texts before you submit the order.
(4) Regarding the contract text (§ 9 Abs 1 Z 3 ECG): we store your order data and the version of these terms in force at the time of your order. We do not currently offer any additional facility to retrieve the contract text later via the website.
(5) We have not subscribed to any code of conduct (§ 9 Abs 1 Z 5 ECG).
§ 4 How the contract is concluded
(1) The presentation of our products on the website is not a legally binding offer. It is a non-binding invitation to you to place an order (invitatio ad offerendum).
(2) By submitting the order with an obligation to pay on the checkout page, you make a binding offer to conclude a contract of sale. Immediately beforehand you are shown the main characteristics of the goods, your personalisation details and the total amount.
(3) As soon as you have submitted your order, it is immediately visible in your customer account; this provides a verifiable confirmation that your order has been received (§ 10 Abs 1 ECG). This is a mere acknowledgement of receipt and does not yet constitute acceptance of your order.
(4) The contract is concluded as soon as we accept your order. Acceptance takes place, at the latest, by our starting production of your order; where we expressly confirm the contract to you, acceptance already takes place at that earlier point.
(5) We are not obliged to accept an order. If we do not accept an order, no contract is concluded and we will refund any payments already made in full and without undue delay.
(6) Since we deliver exclusively to delivery addresses in Austria and Germany (§ 8(2)), we cannot accept orders with a delivery address outside those two countries. In that case no contract is concluded, and we will refund any payment already made in full and without undue delay.
§ 5 The details you provide for personalisation
(1) We produce using exactly the data you enter in the configurator – your spelling, your punctuation and your wording. Please therefore check your entries carefully before you submit the order.
(2) We do not check your texts for factual accuracy, spelling or completeness. If we notice an obvious error before production begins, we will try to draw it to your attention – but we are under no obligation to check or to get in touch.
(3) Changes to your personalisation details are possible as long as we have not yet started production. To request a change, please contact us as quickly as possible at michaeljoebst87@gmail.com or by telephone on 06604736784. We will confirm to you whether the change could still be taken into account.
(4) For errors on our side in typesetting, printing or finishing we are liable in accordance with the statutory provisions. Your rights under § 11 of these terms remain unaffected.
§ 6 Prices and value added tax
(1) All prices are in euros. They are gross prices: they include Austrian value added tax (Umsatzsteuer) at 20% (the standard rate under § 10 Umsatzsteuergesetz 1994 – UStG 1994, the Austrian VAT Act). The tax included is calculated out of the gross amount and shown during the order process.
(2) We apply a single tax rate and a single gross price to all deliveries within our delivery area (§ 8). The same gross price applies to deliveries to Germany as to deliveries within Austria.
(3) No prices are shown on the product pages. The price applicable to your order is shown to you in the configurator and – as a total amount – immediately before you submit your order on the checkout page (§ 8 Abs 1 FAGG; § 9 Preisauszeichnungsgesetz – PrAG, the Austrian Price Labelling Act).
(4) No separate shipping or delivery charges are applied during the order process. The total amount shown to you immediately before you submit the order is the amount you pay in total.
(5) Billing is exclusively in euros. We have no influence on charges that your bank or card issuer may levy on you for a payment (e.g. foreign currency or cross-border fees).
§ 7 Payment
(1) You can pay exclusively by credit card via our payment service provider Stripe. We do not currently offer any other payment methods. You receive this information at the very start of the order process (§ 8 Abs 3 FAGG).
(2) For payment you are forwarded to the checkout page hosted by Stripe at checkout.stripe.com. You enter your card details there, directly with Stripe. We do not collect, see or store your card details, and we do not embed any payment scripts on our own website.
(3) Providing a billing address is mandatory in the order process.
(4) The purchase price falls due on completion of the payment process and is collected via your card issuer.
(5) You can find out which data Stripe processes in this context in our privacy policy.
(6) Note on our current operations: payment processing with Stripe is currently set up exclusively in test mode. As long as that is the case, no real payments take place, and orders placed via the configurator do not result in a binding, payable contract. Paragraphs 1 to 5 describe the process that applies once payment processing has gone live.
§ 8 Production, delivery and delivery area
(1) We only begin production once payment has been received. This applies to all orders.
(2) We deliver exclusively to delivery addresses in Austria and Germany. Regardless of your nationality, your place of residence or your place of establishment, you can order from us on the same conditions, provided you give a delivery address in Austria or Germany (Regulation (EU) 2018/302, the Geo-blocking Regulation). We point out this delivery restriction to you at the very start of the order process (§ 8 Abs 3 FAGG).
(3) We do not currently state a specific production or delivery period during the order process. The statutory rule in § 7a KSchG therefore applies: we deliver without undue delay, and in any event within 30 days of conclusion of the contract.
(4) If we do not deliver on time, you can set us a reasonable additional period for performance (Nachfrist) and withdraw from the contract once that period has expired without delivery. In the cases covered by § 7a Abs 2 KSchG – for example where compliance with the delivery period was essential for you and you told us so before the contract was concluded – you can withdraw immediately, without setting an additional period. We will then refund all payments made without undue delay.
§ 9 Passing of risk and retention of title
(1) As a consumer, you bear the risk of loss of or damage to the goods only once the goods have been handed over to you, or handed over to a third party named by you who is not the carrier (§ 7b KSchG). If you yourself commission a carrier that we did not suggest to you, the risk passes when the goods are handed over to that carrier.
(2) The goods remain our property until payment has been made in full (retention of title, Eigentumsvorbehalt). Since we only produce after payment has been received, this provision is relevant only in exceptional cases – for example where a payment already made is subsequently charged back.
§ 10 Right of withdrawal in distance selling and its exceptions
(1) As a consumer you generally have the right to withdraw from a distance contract within 14 days without giving any reason (§ 11 FAGG). In the case of contracts of sale, the period begins on the day on which you, or a third party named by you who is not the carrier, took possession of the goods. You can declare your withdrawal in any form, for example by e-mail to michaeljoebst87@gmail.com; we will provide you with the model withdrawal form under Annex I Part B FAGG. The details of how the period runs and the consequences of withdrawal are set out in paragraphs 2 to 7.
(2) Under § 18 Abs 1 Z 3 FAGG there is no right of withdrawal for goods that are made to your specifications or are clearly tailored to your personal requirements. This concerns the items we make specifically for you using your individual details – for example the welcome sign ordered via the configurator, which we print with your names, your date and your chosen wording. We cannot reuse such one-off pieces or pass them on to other couples.
(3) This exception does not apply across the board to our entire range. In particular, it does not apply where you merely choose between predefined standard options in the configurator (e.g. format, material thickness, or a typeface from a fixed selection) without any individual details of yours being printed on or worked into the item. Nor does it apply to non-personalised items. For all of those items your 14-day right of withdrawal remains in full. If you order personalised and non-personalised items together, we assess the right of withdrawal separately for each item.
(4) Where there is no right of withdrawal for an item under paragraph 2, that right nonetheless exists if you were not sufficiently informed of this before you placed your order (§ 4 Abs 1 Z 12 FAGG).
(5) Who bears the cost of returning the goods is something we will agree with you on a case-by-case basis before you send the goods back.
(6) If you validly withdraw, we will refund all payments you have made, without undue delay and at the latest within 14 days of receiving your declaration of withdrawal, using the same means of payment that you used (§ 14 FAGG). We may withhold the refund until we have received the goods back or you have provided evidence that you have sent them back.
(7) You only have to compensate us for any diminished value of the goods if that diminished value results from your handling the goods in a way that was not necessary to establish their nature, characteristics and functioning (§ 16 FAGG).
§ 11 Statutory warranty for defects (Gewährleistung)
(1) The statutory warranty provisions apply. For you as a consumer these are in particular the Verbrauchergewährleistungsgesetz (VGG, the Austrian Consumer Warranty Act), supplemented by §§ 922 ff Allgemeines Bürgerliches Gesetzbuch (ABGB, the Austrian Civil Code). We are therefore answerable for the goods being in conformity with the contract at the time of handover.
(2) The warranty period is two years from handover of the goods (§ 10 VGG). If a defect becomes apparent within one year of handover, it is presumed to have already existed at the time of handover – during that period you therefore do not have to prove that the defect existed from the outset (§ 11 VGG). In addition, you can still enforce your warranty rights in court for a further three months after the warranty period has expired.
(3) If the goods are defective, you can first demand repair (Verbesserung) or replacement (Austausch). Where the statutory conditions are met – for example if repair and replacement are impossible, would be disproportionate for us, if we refuse them or do not carry them out within a reasonable period – you can then demand a price reduction or terminate the contract.
(4) As soon as, and to the extent that, the law provides for an extension of the warranty period where you choose repair instead of replacement, that extension applies to you too; in that case we will point out this consequence to you. The statutory provisions in force at the relevant time are decisive.
(5) These rights are mandatory and belong to you by law. We do not exclude them, do not shorten them, and do not make them conditional on any period for notifying defects. This applies expressly to items we have made individually for you: the fact that there is no right of withdrawal for such items under § 10(2) of these terms does not affect your statutory warranty rights in any way.
(6) If there is a defect, please contact us at michaeljoebst87@gmail.com or by telephone on 06604736784. If you send photos with your message, we can usually help you more quickly. This request is intended to make handling easier and is not a precondition for your rights.
§ 12 Commercial guarantees (Garantien)
We have not assumed any guarantees going beyond the statutory warranty. If we do give a voluntary commercial guarantee in an individual case, we will state this expressly and in text form and will include the content required by law. Such a guarantee exists alongside your statutory warranty rights under § 11 of these terms and does not restrict them in any way.
§ 13 Liability
(1) For damage we have caused intentionally or through gross negligence, and for personal injury, we are liable without limitation in accordance with the statutory provisions.
(2) For damage to property caused by slight negligence, we exclude liability to the extent that such an exclusion is legally permissible; it does not apply, in particular, to breaches of material contractual obligations or to damage resulting from an error on our side in typesetting, printing or finishing (§ 5(4)). § 6 Abs 1 Z 9 KSchG remains unaffected – we therefore never exclude liability for personal injury or for gross fault (intent and gross negligence).
(3) Our liability under the Produkthaftungsgesetz (PHG, the Austrian Product Liability Act) and your statutory warranty rights under § 11 of these terms remain unaffected by this section.
(4) These provisions do not involve any reversal of the burden of proof to your detriment.
§ 14 Content you send us
(1) You warrant that you are entitled to use the content you send us for personalisation (names, texts, dates, design requests), that this content does not infringe any third-party rights – in particular copyright, trade mark rights and personality rights (rights to one's own name and image) – and that it does not breach applicable law.
(2) You permit us to use this content in order to produce and deliver your order. Any use going beyond this, in particular for advertising purposes, takes place only with your express prior consent.
(3) If content sent to us is manifestly unlawful, we may refuse to carry out the order and withdraw from the contract. In that case we will refund any payments already made in full.
(4) How we process the names and data you send us – including where these are your guests' data – is explained in our privacy policy.
§ 15 Complaints, contact and dispute resolution
(1) If something is not right, please contact us directly: by e-mail to michaeljoebst87@gmail.com, by telephone on 06604736784, or in writing to Michael Jöbstl, Puchstrasse 145, 8054 Graz, Austria. We aim to deal with your concern as quickly as possible and to reply through the same channel you used to contact us, unless you ask otherwise.
(2) We are not legally obliged to take part in proceedings before an alternative dispute resolution (ADR) entity, and we have not entered into any voluntary commitment to do so.
(3) If we cannot resolve a dispute with you amicably, we will inform you – on paper or on another durable medium, as required by § 19 Abs 3 Alternative-Streitbeilegung-Gesetz (AStG, the Austrian Alternative Dispute Resolution Act) – of the alternative dispute resolution entity competent for us, and will tell you at the same time whether we will take part in proceedings before that entity.
(4) Irrespective of this, the way to the ordinary courts is open to you at all times (§ 18 of these terms).
§ 16 Product safety
(1) We design and produce the items we offer under our own name and are therefore the manufacturer within the meaning of Art 3(8) of Regulation (EU) 2023/988 on general product safety (GPSR).
(2) As the manufacturer, you can reach us at the details given in § 1(2) of these terms: Michael Jöbstl, Puchstrasse 145, 8054 Graz, Austria, michaeljoebst87@gmail.com.
(3) If you have a safety concern about one of our items – for example if parts come loose, or if an item could end up in the hands of children – please contact us at that address. We follow up every report and will inform you of the outcome.
§ 17 If you order as a business (Unternehmer)
(1) These terms are designed for contracts with consumers. If you order in the course of your business, the Konsumentenschutzgesetz (KSchG), the Fern- und Auswärtsgeschäfte-Gesetz (FAGG, the Austrian Distance and Off-Premises Transactions Act) and the Verbrauchergewährleistungsgesetz (VGG) do not apply. In particular, there is then no right of withdrawal under § 10 of these terms.
(2) Towards businesses, the warranty for defects is governed by §§ 922 ff ABGB. The duty to examine the goods and give notice of defects under § 377 Unternehmensgesetzbuch (UGB, the Austrian Business Code) applies: defects must be notified without undue delay after they are discovered, failing which the goods are deemed approved.
(3) For disputes arising from contracts with businesses, the court that has subject-matter jurisdiction for Graz, Austria, shall have exclusive jurisdiction.
§ 18 Final provisions
(1) Amendments to these terms apply only to orders placed after the amendment. The version that was available at the time of your order always applies to your contract.
(2) Should any provision of these terms be invalid or incomplete, the remaining provisions and the contract in all other respects remain effective. The statutory provisions take the place of the invalid provision.
(3) Choice of law: Austrian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory protections granted by the law of the country of their habitual residence.
(4) What this means for you: if your habitual residence is in Germany, for example, the mandatory consumer protection rules of your country of residence continue to apply to you even though we agree on Austrian law (Art 6 of Regulation (EC) No 593/2008, the Rome I Regulation).
(5) Place of jurisdiction: for actions brought against you as a consumer, the mandatory rules on jurisdiction in § 14 KSchG and in Arts 17 to 19 of Regulation (EU) No 1215/2012 (the Brussels Ia Regulation) apply. You can sue us either in the court for your place of residence or at our place of business in Graz, Austria; we can sue you only in the court that has jurisdiction under those provisions.
(6) Version of these terms: 17 September 2026.
