Right of Withdrawal (Rücktritt / Widerruf)
Here you will find out when you can withdraw from an order placed with us, how to go about it, what happens afterwards – and in which cases there is no right of withdrawal. Austrian law calls this right "Rücktrittsrecht"; in Germany the very same procedure is known as "Widerruf". Both terms mean exactly the same thing: within 14 days you can release yourself from the contract without giving any reason. The second part of this page matters: for products that we manufacture specifically according to your details, this right does not apply. That is not true across the board for our entire range, however – only for those items where your individual content actually goes into production. Which items those are, and from which step the rule takes effect, is explained in detail further below.
Who we are and who this notice applies to
**Your contracting partner and the recipient of your notice of withdrawal:**
Michael Jöbstl, Einzelunternehmen (sole proprietorship under Austrian law) Puchstrasse 145 8054 Graz Austria Email: michaeljoebst87@gmail.com Phone: 06604736784 (international: +43 660 4736784) UID-Nummer (Austrian VAT identification number): ATU79764514
This notice applies to contracts that you conclude with us as a consumer (Verbraucher within the meaning of § 1 KSchG – Konsumentenschutzgesetz, the Austrian Consumer Protection Act) through our website as a distance contract. The governing statute is the Austrian Fern- und Auswärtsgeschäfte-Gesetz (FAGG – the Austrian Distance and Off-Premises Transactions Act).
If you order as a business customer (Unternehmer) – that is, for your trade or your professional activity – you have no right of withdrawal under the FAGG. This right is exclusively a consumer right.
The contract language on this website is English. The contracting party remains, in every case, the Austrian sole proprietorship named above. We deliver exclusively to delivery addresses in Austria and Germany. You can also place your order from another EU location, as long as you give a delivery address in Austria or Germany.
Your right of withdrawal: 14 days, no reason required
You can withdraw from your contract within **14 days without giving any reason** (§ 11 FAGG). You do not have to explain why – a clear statement is enough.
This right does not exist for goods that we manufacture specifically to your specifications (§ 18 Abs 1 Z 3 FAGG – Section 18(1) no. 3). What that means in practice, where the line runs, and which items are specifically not affected, is set out in the section "When there is no right of withdrawal – and when there is". Please read that section before you submit a personalised order.
When the 14 days start to run
The period does not start when you place the order, but when you take receipt of the goods (§ 11 FAGG):
- **A single item:** on the day on which you – or a third party named by you who is not the carrier – take possession of the goods. - **Several items from one order, delivered separately:** on the day on which you take receipt of the last item delivered. - **One item delivered in several partial consignments:** on the day on which you take receipt of the last partial consignment.
To meet the deadline it is enough that you **send off your notice of withdrawal before the 14 days expire**. It does not have to have reached us within that period.
How to withdraw
You can declare your withdrawal in any form – any clear statement that you want to release yourself from the contract is sufficient (§ 13 FAGG). You do not need to give a reason, and you do not need to use any particular form.
Send your declaration to:
- **Email:** michaeljoebst87@gmail.com - **Post:** Michael Jöbstl, Puchstrasse 145, 8054 Graz, Austria - **Phone:** 06604736784 (international: +43 660 4736784)
**Practical note:** in the event of a dispute, it is for you to prove that you withdrew in time. An email or a letter is far better suited to that than a phone call. Please state what your withdrawal relates to – for example the order date, the item, and the address it was delivered to.
You can use the model withdrawal form in the next section for this. But you do not have to.
Model withdrawal form
The following text corresponds to the statutory model form set out in Annex I Part B of the FAGG. Because it is prescribed by law, we reproduce it in its official wording rather than in our own words (the version that is legally prescribed in Austria is the German one; the wording below is the official English version of the same EU model form). You can copy it, fill it in and send it to us by email or by post.

What happens after you withdraw
**What we do (§ 14 FAGG):**
We refund all payments you have made **without undue delay, and at the latest within 14 days** of the day on which your notice of withdrawal reaches us. The refund is made using the same means of payment that you used for the order – so for a card payment, back to the same card. This costs you nothing.
Our order process does not currently charge separate shipping costs. You therefore get back the full amount you paid. Should we show shipping costs in future, we would refund the cost of standard outbound delivery in addition to the purchase price; any extra costs arising because you chose a more expensive delivery method do not have to be refunded under the law.
We may withhold the refund until we have received the goods back, or until you have provided proof that you have sent them back – whichever is the earlier.
**What you do (§ 15 FAGG):**
Send the goods back to us **without undue delay, and at the latest within 14 days** of your notice of withdrawal, to: Michael Jöbstl, Puchstrasse 145, 8054 Graz, Austria. Here too, sending them off in time is enough.
Who bears the direct cost of returning the goods is something we agree with you on a case-by-case basis before you send the goods back.
**Diminished value:** you may examine the goods as you would in a shop – that is, establish their nature, characteristics and functioning. You only have to compensate us for a loss in value if it results from handling that goes beyond this, for example signs of use, scratches, or a damaged protective film.
**Note on the current status:** Payment processing on our website is currently running in test mode. At present, no real payments are taken and no binding, payable orders come into existence. The refund rules above apply once real orders and payments become possible.
When there is no right of withdrawal – and when there is
The law exempts certain goods from the right of withdrawal. The provision relevant to us is **§ 18 Abs 1 Z 3 FAGG** (Section 18(1) no. 3): there is no right of withdrawal for goods that are **made to your specifications** or are **clearly tailored to your personal needs**.
The reason is simple: a sign bearing your names and your wedding date is something we cannot sell to anyone else.
**This exception does not apply across the board to our entire range.** It has to be interpreted narrowly and must be assessed separately for each individual item.
**There is no right of withdrawal** where your own content actually goes into production – for example your names, your wedding date, text you enter freely, guests' names, a destination you provide for a QR code, or a file you send us. In that case a one-off piece is created that is produced specifically for you.
**The full 14-day right of withdrawal remains in place** if you
- order non-personalised standard goods, that is, finished items without your content; - select only from the predefined standard options in the configurator – for example only the format, the material, or one of several fixed colour variants – without any content of your own being printed on the item or worked into it.
Under the case law, merely selecting from a predefined set of options does not in itself turn goods into a custom-made item.
**Statutory duty to inform:** wherever the exception applies, you must be clearly told so before you place your order. If that notice is missing, your right of withdrawal remains in place.
**The current state of our shop:** the only item you can currently order through a configurator is the personalised welcome sign from the wedding section. The other product pages – table stationery set, personalised ring box, wedding vow books, guest book with keepsake box, name cards as guest favours, QR code display stands, save-the-date magnets – are purely informational pages with no ordering function.
From which step your order counts as individually manufactured
What matters is the moment at which you **submit your individual details in the configurator to us in a binding order that obliges you to pay**. From that point on, there is a manufacture to your specifications – and the right of withdrawal for that item therefore does not apply.
As long as you have not yet submitted the order, you can change or correct your entries at any time, or abandon the process. Please make use of this step and check the spelling of names, the date and the text carefully: typing errors in your own details will be printed as they stand.
We only start production once payment has been received. That does **not**, however, push the decisive moment back. Under the case law of the Court of Justice of the European Union (judgment of 21 October 2020, C-529/19, Möbel Kraft), the exception applies from the outset – irrespective of whether we have already begun manufacturing. So no right of withdrawal arises merely because production has not yet started.
If you notice a mistake in your details after submitting the order, please contact us as quickly as possible at michaeljoebst87@gmail.com. Whether a change is still possible depends on how far production has progressed. From that point on, you no longer have a legal entitlement to such a change.
If we fail to inform you properly
If we do not inform you about your right of withdrawal at all, or inform you inadequately, the withdrawal period is extended by **twelve months** (§ 12 Abs 1 FAGG). If we supply the information within those twelve months, the 14-day period starts to run on the day on which the information reaches you.
The same applies, in substance, to the exclusion for personalised goods: it only takes effect if we informed you about it clearly before you placed your order. Without that notice, your right of withdrawal remains in place.
The right of withdrawal is not the same as the statutory warranty
These two rights are frequently confused. They must be kept strictly apart:
- **Right of withdrawal (Rücktrittsrecht, FAGG):** you release yourself from the contract without any reason. It does not require anything to be wrong with the goods – and it does not apply to goods manufactured individually for you. - **Statutory warranty for defects (Gewährleistung, VGG – Verbrauchergewährleistungsgesetz, the Austrian Consumer Warranty Act):** this applies where the goods are defective – they arrive damaged, do not correspond to what was agreed, or have a production fault.
**The statutory warranty applies to personalised goods as well – without exception.** It cannot be excluded or shortened to your detriment.
The warranty period is two years from handover (§ 10 VGG). During the first year, a defect that appears is presumed to have already been present at handover (§ 11 VGG). Once the warranty period has expired, a further limitation period of three months remains in which you can still enforce your claim (§ 28 VGG). Your primary entitlement is to repair or replacement; only after that do a price reduction or rescission of the contract come into consideration.
If a printing error results from our own templates or our production, that is a warranty case – not your problem. If it results from an entry you made in the configurator, it is not.
In this document we do not promise you any voluntary commercial guarantee (Garantie) going beyond your statutory rights.
For customers in Germany
We also deliver to Germany. What is called "Rücktritt" in Austria is known to you in Germany as "Widerruf" – in both countries the legal position goes back to the same EU directive (2011/83/EU).
In practice this means the same thing for you: 14 days from receipt of the goods, no reason required, and no particular form for the declaration. German law also contains a materially identical exception for goods manufactured to customer specifications or clearly tailored to personal needs.
Mandatory consumer protection provisions of German law remain applicable to you insofar as they are more favourable to you than Austrian law (Article 6(2) of the Rome I Regulation (EC) No 593/2008).
Applicable law
Austrian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory protections granted by the law of the country of their habitual residence.
Questions about withdrawal
If you are unsure whether a right of withdrawal exists for your item, it is better to ask us before ordering than afterwards:
